Introduction

These Terms & Conditions form the agreement between Trip Whisperer Safaris (the “Organizer/Company”) and the person or group booking services (the “Traveler/Client”). By making a booking or paying any deposit you accept these terms in full.

1. The Travel Contract

The Travel Contract comprises: (a) these Terms & Conditions; (b) the booking confirmation issued by Trip Whisperer Safaris; (c) the itinerary and service descriptions; and (d) any supplementary documents issued in writing.

2. Definitions

  • Traveler/Client: any person who accepts the contract or for whom the booking is made.
  • Organizer/Company: Trip Whisperer Safaris.
  • Tourism Package: a combination of at least two travel services sold for the same trip.
  • Unavoidable & Extraordinary Circumstances: events outside the control of the parties.
  • Minor: a person under 18 years of age.

3. Reservations & Payments

Bookings are confirmed only once Trip Whisperer Safaris receives the required deposit (or full payment) and issues a written confirmation. Payment methods include bank transfer, credit/debit card or approved online payment gateways.

4. Prices & Substitutions

All prices are quoted in the currency specified on the booking confirmation. The Company reserves the right to substitute services with equivalent or higher-standard alternatives where necessary.

6. Changes or Cancellation by Trip Whisperer Safaris

Trip Whisperer Safaris may alter itineraries due to weather, park access, safety, or supplier issues. If the Company cancels a package prior to departure, the Traveler will receive a full refund of monies paid for the affected services.

7. Traveler Obligations

  • Hold valid passports, visas, vaccination certificates and travel documents.
  • Disclose medical conditions, mobility limitations or dietary requirements at booking.
  • Comply with local laws and park regulations.
  • Ensure personal belongings are secure.
  • Provide guardianship and documents for minors.

8. Health & Safety

Vehicles and equipment are maintained to high standards. Guides carry first-aid kits and are trained in emergency procedures. Travelers must obtain medical and evacuation insurance before travel.

9. Insurance

Comprehensive travel, medical and repatriation insurance is mandatory for all Travelers.

10. Liability

Trip Whisperer Safaris acts as an agent for independent suppliers. The Organizer accepts liability only for negligence in the services it directly provides and limited to the level permitted by law.

11. Complaints

Issues must be reported immediately to the guide or representative. If unresolved, a written complaint should be submitted to info@tripwhisperersafaris.com within 14 days of trip completion.

12. Data Protection

Personal data will be collected and processed in accordance with applicable laws and our privacy policy.

13. Governing Law

These Terms are governed by the laws of Kenya. Any dispute will be subject to the jurisdiction of Kenyan courts.
